Under article 4 of the Refugee Regulations, Executive Decree No. 36831-G, it is an International Protection Category defined as (unofficial translation):
"Any foreign national recognized as such by the Restricted Visa and Refugee Commission, owing to well-founded fear of being persecuted for reasons of race, religion, nationality, gender, membership of a particular social group, or political opinion, who is outside the country of their nationality or residence and is unable, or owing to such fear, unwilling to avail themselves of the protection of that country. Being stateless and outside the country where they formerly had their habitual residence, they are unable, or owing to such fear, unwilling to return to it."
